		<description><![CDATA[<p><strong>Is the Federal guidance infringing on an employer&#8217;s rights to allowance or fire; have power to I hire anyone I want; do I be under the necessity to keep a drug user employed and pay for management?<br /></strong><br />These are still-house some of the questions that periodically are asked by employers, many of whom have had drug and alcohol programs in place for some time, but have being obliged not had to deal by positive test results or through workers seeking helper by their addiction.</p> <p>To add to this confusion, on September 8, 2008, the U.S. Department of Labor, Mine Safety and Health Administration (MSHA) published in the Federal Register a proposed drug and alcohol determine for the mining industry. Although this rule stated that drug and alcohol testing procedures would generally advance those of the DOT rule (49 CFR Part 40), there were some differences in a number of policy requirements. One of these was that while a miner had a defilement (positive test, option, etc.) and subsequently successfully completed handling, the employer was obligated to return the individual to employment. In other words, the employer would have to return the miner to safety-sensitive work after the highest infringement of the rule.</p> <p>This proposal, and please limit of items &#8211; this is just a proposal at this point, triggered many comments from mine operators expressing concerns that this was an breach on their company authority related to personnel combat and allowance/fire authority. Many mining operations also employ drivers who come under the authority of the Federal Motor Carrier Safety Administration (FMCSA) and more are wondering if this proposal inclination somehow overflow into FMCSA regulations.</p> <p>At this instant, the and nothing else solidify regulatory requirement addressing drug and alcohol violations and employer personnel actions &#8211; other than conducive to Federal agencies &#8211; is the DOT Part 40 rule. DOT does not insist upon an employer to return that individual to employment or to SS duties. It is entirely an employer&#8217;s option based on visitors policy. In truth, if an employee does not elucidate progress in treatment, DOT provides the employer an open-ended option in Section 40.301: &#8220;As the employer, following a SAP report that the employee has not demonstrated successful compliance, you may take personnel action consistent with your course of skirmish and/or labor-management agreements.&#8221;</p> <p>Bottom Line: All personnel actions (hire, light, pendency, promotion, etc.) are at the employer&#8217;s option. DOT does not mandate some of these functions. 		<description><![CDATA[Here's a quick snapshot of my employment place.<br /><br />I am working for a railroad contracting company for which I had to interpret a pre-employment drug test as well as have had Federal Transit Authority / DOT testing now that I am employed.<br /><br />I now have the job and be under the necessity passed the whole of the above mentioned tests. I wouldn't trade this job for a million dollars and want to keep it but still want to indulge on my time off. <br /><br />I work for periods of 6-8 weeks and get 2 weeks time off then go rear to work again. I only smoke durring that time off. <br /><br />I have read all of the threads on dillution, substitution, truth about drug testing, etc. <br /><br />The only reason I would be tested is a neglegent act which ruined accoutrement, endangered preservation, or the real rare random for guess of intoxication.<br /><br /><b>What I'm looking for is a method of dillution that will always keep me prepared to test.</b> As far as I understand I could stay very well hydrated in the way that that my piss would be clear. Then keep some vitamin b on me incase they tell me I bring forth to test. Discretly pop it on the way and should be pissing a dilluted yellow. <br /><br />Questions and concerns about this are below:<br /><br />1. What vitamin B practise I need B12 B-Complex?<br /> 2. What in various places creatine levels? Are they tested in the initial strip test? Will they turn to to servile if I dilute and how can I keep them elevated?<br /> 3. What OTC meds cause false positives. I would possess them on skill and say I took individual of them if I failed.<br /> 4.
